Property owners are responsible for keeping things reasonably safe for visitors. The legal term for this is called “duty of care”.
Property owners need to do two main things:
- Fix dangerous conditions (like wet floors or broken steps)
- Put up warning signs if they can't fix a problem right away
When an owner doesn't do these things, we call it a "breach of duty." Think of it like breaking a promise to keep visitors safe.
For example, if a store owner knows about a spill but doesn't clean it up or put up a "Wet Floor" sign, they've breached their duty. If you slip on that spill and get hurt, you might deserve money to help pay for your injuries.
However, there are exceptions. Property owners might not be responsible if:
- The danger was obvious to anyone (like a clearly visible large puddle)
- You were in an area where visitors aren't allowed (like employee-only sections)
- You were using the property in an unexpected or dangerous way
- The owner had no reasonable time to discover and fix the problem (like a spill that happened seconds before you fell)
- You were trespassing on private property without permission
To win your case, you have to prove the owner knew (or should’ve known) about the danger but didn't do what they should’ve to make things safe.
Win by Proving Causation & Damages
To win your slip and fall case, you also have to prove their actions directly caused the accident and your injuries.
Causation. This means proving that your fall happened because of the property owner's mistake. You must show a clear link between their failure to fix a danger and your accident. For example, you slipped because they didn't clean up a spill.

The kind you can’t count are things that affect your life but are harder to put a price on (pain and suffering).
